FameCake is a digital screen advertising platform operated by FameCake Ltd. FameCake acts solely as a technology platform for displaying user-submitted content on digital screens. We are not a publisher or broadcaster. Our service enables users to create personalized content for display on digital screens across various locations.

We utilize artificial intelligence to assist in design creation based on your content. While we strive for excellence, perfection is not guaranteed. The final appearance of your content may vary based on the specific screen display and environmental conditions.

By using FameCake, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding contracts
• All information you provide is accurate, current, and complete
• You will maintain the accuracy of such information
• Your use of the service complies with all applicable laws and regulations

FameCake welcomes creative and celebratory content including, but not limited to:

• Birthday greetings and celebrations
• Wedding announcements and congratulations
• Anniversary messages
• Achievement celebrations
• Business promotions (subject to approval)
• Public service announcements (subject to approval)

The following types of content are strictly prohibited:

• Unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
• Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights
• Spam, chain letters, or unsolicited mass distribution
• Sexually explicit or pornographic material
• Content promoting tobacco products, cannabis, firearms, weapons, or illegal substances
• Content that promotes illegal activities or violates any applicable law
• Hate speech or discriminatory content targeting any individual or group

We reserve the right to refuse service, remove content, or terminate accounts at our sole discretion if content violates these terms.

By submitting content for display on FameCake screens, you confirm that you are solely responsible for the content you post. FameCake acts only as a platform for displaying user-submitted content and accepts no liability for the nature, accuracy, legality, or appropriateness of any content posted by users. Any claims, complaints, or legal actions arising from a submitted post shall be the sole responsibility of the individual who submitted the content, not FameCake or the screen operator.

Pricing: Advertisement pricing varies based on duration, location, and screen specifications. All prices are displayed in the applicable currency before posting.

Multi-Screen Locations: Some locations have more than one screen. These are sold as a single unit at one price for the whole location. The number of screens shown is the most that are in service when you post, and some may be offline on the day. Your post runs on the screens there that are in service. A screen that comes into service or joins the location during your post may also show your post, at no extra cost, but its plays are not guaranteed unless it was part of what you paid for.

Play Guarantee: Each screen you pay for carries a minimum of 90 plays a day, counted across the whole location. Plays on any screen at the location count towards that total, so another screen there can make up for one that is offline. Plays on screens we add to your post at no charge, at any location, also count. If your post still falls short, we put it right by extending your post or moving it to another screen at no extra cost. This make-good is the remedy for a screen that is offline, faulty or showing fewer plays, and it replaces any refund or credit for that shortfall.

Display Quality: Screens are physical displays in public places. Brightness, colour and sharpness vary between screens, and a screen can show minor faults such as dead pixels, a colour cast, or a section of the panel that is dim, distorted or inverted. These do not stop your post being delivered and are not grounds for a refund or credit. If a fault makes your post unreadable, tell us during your post and we will move or extend it.

Posting Window: Posts can be scheduled up to 30 days in advance, subject to availability.

Payment Processing: All payments are processed securely through Stripe. Payment is required at the time of posting.

Cancellation Policy: Posts may be cancelled before the scheduled start date. A £1 cancellation fee applies to paid posts to cover payment processing costs. Posts that are already live cannot be refunded.

Delivery Issues: Refunds and credits are not given for issues that a make-good puts right. Nothing in these terms affects your statutory rights as a consumer.

Unfinished Posts: If you start a post and never pay for it, we delete it 60 days later, along with any images you uploaded to it. Paid posts are unaffected.

Your Content: You retain all ownership rights to content you submit. By uploading content, you grant FameCake a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content for the purpose of providing our services.

Platform Content: The FameCake platform, including its design, features, graphics, and software, is owned by FameCake Ltd and protected by intellectual property laws.

AI-Generated Elements: Any AI-generated design elements created through our platform are licensed to you for use in your advertisements on our platform.

To the fullest extent permitted by law, FameCake Ltd disclaims all liability for:

• Any damages arising from your use or inability to use our service
• Unauthorized access to or alteration of your content
• Any third-party conduct or content on the platform
• Technical malfunctions or display issues beyond our reasonable control
• Acts of God, natural disasters, or other force majeure events

Our maximum liability for any claim arising out of or relating to these terms shall not exceed the amount you paid for the specific service giving rise to the claim.

You agree to indemnify and hold harmless FameCake Ltd, media owners, screen operators, and our affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these terms
• Your violation of any rights of another party
• Your content or advertisements
• Your use of the service

We reserve the right to modify, suspend, or discontinue any aspect of our service at any time without prior notice. We may also update these terms periodically. Continued use of the service after changes constitutes acceptance of the modified terms.

These terms and conditions are governed by the laws of England and Wales. Any disputes arising from these terms or your use of FameCake shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

A customer with a paid post gets a personal invite link. Accounts posting through a partner group are not included.

• The friend's discount. Anyone except the link's owner gets £20 off a post of £50 or more, once per link per account. One code applies to each post.
• The referrer's reward. When the friend's post first plays, the referrer gets a voucher for £20 off a post of £30 or more. There is one reward for each friend, for the first link they use, and each voucher is valid for 365 days.
• When a reward is due. The referrer must have at least one post that was charged and not cancelled or refunded in full. No reward is due when the friend paid with a card the referrer has used, and each payment card can earn a referrer one reward. Rewards beyond 10 in a calendar month are checked by a person before they are issued.
• Some purchases, such as proposals and fixed-price offers, cannot take a code. Discounts and vouchers have no cash value.

We may withhold, cancel or reverse a discount or reward where we reasonably believe the offer has been misused, for example through self-referral, several accounts held by one person, shared payment cards, or a payment that is later refunded or disputed. If we do, we will tell you why when you ask through Support. We may change or end the offer at any time. Vouchers already issued stay valid until they expire.
